Observation
8) There is a deck out the back exit of the home in the outdoor play area. This deck has a railing with horizontal steel cables in it as a barrier to prevent falls from the deck. The cables are positioned less than 3 1/2 inches apart, but two of the cables are broken and thus, not in good condition. There is a gap of 6 1/2 inches in these two areas, which poses a hazard of head entrapment if a child were to slip through this wider gap. 8) The horizontal cables in the deck railing are flexible enough to spread apart wider than 3 1/2 inches, which presents a hazard of a child slipping through the cables. Dispute Description: I had my old deck and deck rail replaced because it was showing signs of wear. I spent money on a cable deck railing as it was the only option within my budget. I had it installed by licensed contractors and have never had a problem. When I take my kids outside to play in the back yard we use the side exit as the door from our classroom opens directly to it. We do not use the back door exit which leads to the deck. When using the side exit there are no stairs for the kids to use. When we are playing outside the deck isn't an area where kids are allowed to play. All their toys and activities take place on the grass or the patio. I do not see my deck as a safety hazard and the cables that are in the deck are thick and heavy duty. Kids do not play on the deck and if we were to use the deck it would be to enter into the house though the backdoor in which they would just walk up the stairs. There are no toys or anything of interest on the deck for the kids. I do not have money to put up an additional barrier or to replace the deck rail that was professionally installed.
